AGREEMENT BETWEEN CUSTOMER AND ACE RENT A CAR RESERVATIONS, INC.

THANK YOU for using the ACERENTACAR.com website (the "Website"). ACE’s goal is to provide you with the highest possible Customer Satisfaction and ACE has made all reasonable efforts to ensure the accuracy of the information contained on this Website. However, issues with the technology involved do occasionally occur and may result in errors. Although we cannot guarantee foolproof operation of the Website, ACE guarantees that it will stand behind your reservation and will assist you in taking care of any problems you may have with your reservation.

Our Website is intended to assist you in obtaining reservations and is offered to you under the terms and conditions set forth in this agreement (the “Agreement”). By using this Website, you are agreeing to these terms and that this Agreement will apply to all transactions booked on this Website or through our call centers.

The terms "our", "ACE", and "ACE Reservations" in this Agreement refer to ACE Rent A Car Reservations, Inc., a United States corporation formed under the laws of the State of Indiana, ACE Reservations, ACE Reservations System, ACE Rent A Car, Inc., and their present and former subsidiaries, parents, assigns, successors, affiliated corporations, divisions, predecessors, officers, directors, employees, attorneys, agents, insurers, and all other related persons, firms and corporations.

The terms "you", "your", and "customer" refer to the customer visiting the Website and/or booking a reservation through ACE on this Website or through our call center.

PLEASE READ THIS AGREEMENT CAREFULLY. If you do not agree to all of these terms and conditions, please do not use or make bookings through either this Website or our call centers. ACE reserves the right at any time, at our sole discretion, to change or otherwise modify the Agreement without prior notice, and your future use of this Website acknowledges your acceptance of any updated or modified Agreement.

ACE is acting as your agent in acquiring reservations and other related services from independently owned and operated rental car businesses (“Independent Operators”). These Independent Operators accept customer reservations through ACE and have been granted a license to display and use ACE trademarks and intellectual properties; they are not agents or employees of ACE. ACE is therefore not liable for: the acts, errors, omissions, representations, warranties, breaches or negligence of any Independent Operator and/or its employees, agents, or related suppliers, or or any personal injuries, death, property damage, or other damages or expenses resulting from a customer’s transactions with the Independent Operator. ACE is also not responsible for: any injuries, damages or losses to customers caused by, or related to, any action of a third party, terrorist activities, social or labor unrest, mechanical failures or difficulties, weather conditions, or any other condition outside of ACE’s control.

ACE SPECIFICALLY DISCLAIMS ALL EXPRESSED OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. AS WELL AS: ALL WARRANTIES THAT THIS WEBSITE IS FREE OF VIRUSES OR OTHER HARMFUL MATERIALS, AND DISCLAIMS ALL WARRANTIES WITH REGARD TO THE INFORMATION PROVIDED IN THIS WEBSITE, THE SOFTWARE USED, OR THE PRODUCTS OR SERVICES PROVIDED THROUGH THE WEBSITE.

In no event shall ACE be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of, or in any way connected with, your access to, display of or use of this Website; any computer viruses, information, software, linked sites, products, and services obtained through this Website. Or otherwise arising out of the access to, display of or use of this Website, whether based on a theory of negligence, contract, tort, strict liability, even if ACE may have been advised of the possibility of such damages.

If ACE is found liable for any loss or damage which arises out of or is in any way connected with any of the occurrences described above, despite the limitations set forth in this Agreement, then the liability of ACE will in no event exceed, in the aggregate, the greater of: the service fees paid to ACE in connection with your transaction(s) on this Website.

You acknowledge and agree that the limitations of liability contained in this Agreement fairly reflects the allocation of risk between the parties and shall survive and apply as logical under the circumstances.
